SwiftWire Terms and Conditions

1. Acceptance of Terms

By using SwiftWire (the “App” or “Platform”), you accept these Terms and Conditions and agree to comply with them. If you do not agree, you must discontinue use of the service immediately.

2. Eligibility

To use SwiftWire, you must be at least 18 years old and legally capable of entering into a binding agreement. You must also successfully complete our Know Your Customer (KYC) process where required.

3. Services Provided

  • Sending and receiving money locally and internationally
  • Currency conversion using real-time FX rates
  • Crypto buy/sell/swap (BTC, ETH, USDT)
  • Issuance of virtual cards for online and international spending
  • Mobile money integration (MTN, Orange – Cameroon)
  • Wallet funding through bank transfer, mobile money, or card

Services may vary by country or region based on local laws and partner APIs (Flutterwave, Wise, Stripe/Paystack, Binance).

4. Account Registration

To access our services, you must create an account and provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

5. KYC & Compliance

SwiftWire complies with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) regulations. We may collect personal documents and verify identity through third-party providers. Non-compliance may lead to account suspension.

6. Fees and Charges

  • Transaction fees for money transfers and currency swaps
  • FX markups for currency conversions
  • Crypto trading spreads or commissions
  • Card issuance and maintenance fees

All fees are clearly shown at the point of transaction.

7. Currency Conversion

Currency swaps are powered by Wise and are subject to real-time rates. You agree to accept the rate displayed at the time of transaction, including applicable fees.

8. Crypto Transactions

Crypto services are powered by Binance API. Crypto values are highly volatile, and SwiftWire is not liable for losses due to market fluctuations.

You must not use SwiftWire for illegal crypto activities, including money laundering or bypassing local restrictions.

9. Use of Virtual Cards

Cards issued via Stripe/Paystack may be used for online and international purchases. Do not use cards for restricted transactions such as gambling, adult services, or any unlawful activities.

SwiftWire reserves the right to freeze or cancel a card if suspicious activity is detected.

10. Prohibited Use

  • Use SwiftWire for illegal transactions
  • Circumvent FX limits or regulations
  • Attempt unauthorized access to our systems
  • Reverse-engineer, duplicate, or resell any SwiftWire services

Violations may result in immediate suspension or termination of your account.

11. Liability & Disclaimers

SwiftWire is not liable for:

  • Losses due to user negligence, incorrect account details, or unauthorized access
  • Delays or failures from third-party providers (Flutterwave, Wise, Binance, etc.)
  • Fluctuations in crypto or FX rates

All services are provided “as is” without warranties of any kind.

12. Termination

You may close your account at any time. SwiftWire may suspend or terminate accounts for fraud, misuse, or breach of terms, with or without notice.

13. Privacy Policy

Your personal data is collected and handled according to our Privacy Policy, in compliance with global data protection laws (e.g., GDPR).

14. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on the app or website, and continued use of the service constitutes acceptance.

16. License to Use SwiftWire

Subject to your compliance with these Terms, SwiftWire grants you a limited, non-exclusive, non-transferable, revocable license to access and use the SwiftWire mobile application and website for personal, non-commercial purposes.

You may not:

  • Copy, modify, distribute, sell, or lease any part of our services or software
  • Reverse engineer, decompile, or attempt to extract the source code of the SwiftWire app
  • Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.)
  • Use the app in any way that violates applicable laws or regulations
  • Create derivative works or use automated systems (bots, scrapers) to access our services

All rights not expressly granted to you are reserved by SwiftWire and its licensors.

17. Payment Terms & Refunds

17.1 Payment Methods: SwiftWire supports various payment methods including bank transfers, mobile money (MTN, Orange), debit/credit cards, and cryptocurrency. All payments are processed through secure third-party payment processors (Flutterwave, Stripe, Paystack, Wise, Binance).

17.2 Transaction Fees: Fees are clearly displayed before you confirm any transaction. Fees may include:

  • Money transfer fees (domestic and international)
  • Currency conversion markups
  • Crypto trading spreads or commissions
  • Virtual card issuance and maintenance fees
  • Withdrawal and deposit fees (depending on method)

17.3 Refund Policy: Due to the nature of financial transactions, most transactions are final and non-refundable once processed. Refunds may be issued only in the following circumstances:

  • Technical error on SwiftWire's part that resulted in duplicate charges or incorrect amounts
  • Unauthorized transactions reported within 24 hours and verified by our fraud team
  • Service failure where the transaction was not completed as promised

To request a refund, contact support@theswiftwire.com within 48 hours of the transaction with your transaction ID and reason for the refund request. Refunds are processed within 7-14 business days.

17.4 Escrow & Holding: In certain cases (e.g., pending verification, dispute resolution, compliance reviews), SwiftWire or its payment partners may temporarily hold funds in escrow until the issue is resolved. You will be notified of any such holds.

18. User Responsibilities & Prohibited Activities

18.1 Account Security: You are responsible for maintaining the confidentiality of your account credentials. Do not share your password, PIN, or two-factor authentication codes with anyone. Notify us immediately at support@theswiftwire.com if you suspect unauthorized access.

18.2 Accurate Information: You must provide accurate, current, and complete information during registration and KYC verification. Providing false information may result in account suspension or termination.

18.3 Prohibited Uses: You agree not to use SwiftWire for any of the following:

  • Illegal activities including fraud, money laundering, terrorist financing, or tax evasion
  • Purchasing illegal goods or services (drugs, weapons, stolen items, etc.)
  • Gambling, adult content, or other restricted merchant categories (as defined by card networks)
  • Circumventing currency controls, sanctions, or export restrictions
  • Sending spam, phishing attempts, or malicious software through our platform
  • Manipulating exchange rates, exploiting system vulnerabilities, or engaging in arbitrage abuse
  • Creating multiple accounts to abuse promotions or referral programs
  • Harassing, threatening, or impersonating other users or SwiftWire staff

19. Account Suspension & Termination

19.1 Right to Terminate: SwiftWire reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for any of the following reasons:

  • Violation of these Terms & Conditions
  • Suspected fraud, money laundering, or other illegal activities
  • Failure to complete KYC/AML verification
  • Chargebacks, disputes, or payment failures
  • Abusive behavior toward support staff or other users
  • Inactivity for an extended period (typically 12+ months with zero balance)

19.2 Effect of Termination: Upon termination, you will lose access to your account and all associated services. Any remaining balance (after deducting applicable fees, chargebacks, or liabilities) will be returned to your linked bank account or payment method within 30 days, subject to verification.

19.3 Voluntary Account Closure: You may close your account at any time by following the instructions in the app or contacting support. Ensure you withdraw all funds before requesting closure. See our Delete Account page for details.

20. Disclaimer of Warranties

20.1 "AS IS" Basis: SwiftWire services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of uninterrupted, timely, secure, or error-free service
  • Accuracy or reliability of information, exchange rates, or transaction processing

20.2 Third-Party Services: SwiftWire relies on third-party providers (Flutterwave, Wise, Binance, etc.) for payment processing, currency conversion, and crypto trading. We do not guarantee the availability, performance, or accuracy of these external services.

20.3 Market Risks: Cryptocurrency and foreign exchange markets are highly volatile. SwiftWire is not responsible for losses due to market fluctuations, price changes, or liquidity issues.

21. Limitation of Liability

21.1 Indirect Damages: To the maximum extent permitted by law, SwiftWire, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Costs of substitute services or downtime
  • Damages arising from unauthorized access, hacking, or data breaches

21.2 Maximum Liability: In no event shall SwiftWire's total liability to you for all claims arising out of or related to these Terms or your use of the services exceed the greater of (a) $100 USD or (b) the total fees you paid to SwiftWire in the 12 months preceding the claim.

21.3 Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

22. Indemnification

You agree to indemnify, defend, and hold harmless SwiftWire, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of SwiftWire services
  • Your violation of these Terms & Conditions
  • Your violation of any laws, regulations, or third-party rights
  • Unauthorized access to your account due to your negligence

23. Governing Law & Dispute Resolution

23.1 Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of the United States and the State of Maryland, without regard to conflict of law principles. International users also agree to comply with applicable international digital commerce laws and regulations.

23.2 Jurisdiction: Any disputes arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Maryland, USA. You consent to the personal jurisdiction of these courts.

23.3 Arbitration (Optional): For disputes under $10,000, you may elect binding arbitration instead of court litigation. Arbitration will be conducted under the rules of the American Arbitration Association (AAA). Each party will bear its own costs.

23.4 Class Action Waiver: You agree to resolve disputes with SwiftWire on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

24. Force Majeure

SwiftWire is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, pandemics)
  • Government actions, sanctions, or regulatory changes
  • War, terrorism, civil unrest, or labor strikes
  • Internet outages, cyberattacks, or third-party service failures
  • Banking system disruptions or payment network downtime

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

26. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, EULA, and any other policies referenced herein, constitute the entire agreement between you and SwiftWire regarding your use of our services. These Terms supersede any prior agreements or understandings.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without SwiftWire's prior written consent. SwiftWire may assign these Terms to any affiliate, successor, or acquirer without restriction.

28. Waiver

SwiftWire's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of SwiftWire.

29. Updates & Modifications

SwiftWire reserves the right to update, modify, or replace these Terms at any time. Material changes will be communicated via email, in-app notification, or a prominent notice on our website at least 30 days before taking effect.

Your continued use of SwiftWire after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using our services and close your account.
